Returning the goods

  • Return and exchange of goods
    1.1. Return and exchange of goods is carried out in accordance with the legal acts of the Republic of Lithuania in force at the time of purchase of the goods, in accordance with the Resolution No. 22 of the Government of the Republic of Lithuania of 2014. July 22. 738 “On Amendments to Resolution No. 697 of the Government of the Republic of Lithuania of 11 June 2001 “On the Approval of the Rules of Retail Trade” and in accordance with the procedure established in Articles 6.228(10) and 6.228(11) of the Civil Code.
    1.2. The Buyer has the right to withdraw from a distance purchase and sale contract concluded outside the place of sale without giving any reason. The Buyer may exercise the right to return the goods within 14 (fourteen) calendar days from the date of collection or delivery of the goods to him, informing the Seller thereof in accordance with the procedure established in clause 3.2 of the Rules, informing the Seller by e-mail eshop@juara.lt. The Buyer’s right to withdraw from a distance contract and a contract concluded outside the place of sale does not apply to:
    • contracts for perishable goods or goods with a short shelf life;
    • contracts for packaged goods that were unpacked after delivery and which are unsuitable for return for health or hygiene reasons;
    • contracts for goods manufactured according to the special instructions of the consumer, which are not pre-manufactured and which are manufactured taking into account the personal choice or instruction of the consumer, or for goods that are clearly adapted to the personal needs of the consumer;
    • contracts for goods that, due to their nature, are inseparably mixed with other items after delivery;
    • contracts for the delivery of newspapers, books, periodicals or magazines, except for contracts for subscriptions to these publications;
    • goods ordered according to the special wishes of the customer;
    • other contracts provided for in paragraph 2 of Article 6.228 (10) of the Civil Code.
    1.3. The returned goods must be in their original, neat packaging, not damaged by the Buyer, not lost their commercial appearance, i.e. the label is not damaged, the protective film is not torn off, etc., in the same configuration as when the Buyer received them, and the document of purchase of the goods must be presented.
    1.4. The Buyer may deliver the returned goods to the address specified by the Seller or send them using courier services. In the event that the goods are returned based on the right provided for in clauses 3.2. and 7.2, the Buyer shall bear the direct costs of returning the goods. When the wrong goods and/or goods of poor quality are returned, the Seller undertakes to take such goods and replace them with similar suitable goods. In the event that the Seller does not have similar goods, he shall return the money paid for the goods to the Buyer.
    1.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the procedure for returning the goods established in this article.
    1.6. The money for the returned goods, including delivery costs, shall be returned to the Buyer after the goods are returned to the Seller or when the Buyer provides evidence that the goods have been sent to the Seller, whichever occurs first, except in cases where, according to Rules If the Buyer withdraws from the contract, the Seller is obliged to take back the goods. When the goods are returned (both when returning through intermediaries (couriers) and when returning the goods directly to the Seller), the money is returned to the Buyer in the same way as he made the payment, for example, by transfer to the account from which the payment was made, etc. The money paid is returned within 10 (ten) business days.
    1.7. In the event of the sale of poor-quality goods, the Buyer may request to replace the goods of inadequate quality with the goods of adequate quality, reduce the price of the goods, return the goods and recover the money paid for them. The exchange and return of poor-quality goods is carried out in accordance with the procedure established by these Rules and the legal acts of the Republic of Lithuania. Poor-quality goods are returned at the Seller's expense.
